Occupational Health and Safety Regulation

The Occupational Health and Safety Regulation defines terms for the OHS Act and OHS Code and authorizes the Minister to establish programs.

Interpretation

 

1(1)

In this Regulation, “Act” means the Occupational Health and Safety Act , SA 2020 cO-2.2.

1(2)

For the purposes of sections 13(1)(a) and 14(1)(a) of the Act, “regularly employs” does not include the employment or engagement of workers to whom monetary compensation is not paid.

1(3)

For the purposes of sections 13(2) and 14(2) of the Act, “regularly employed” does not include the employment or engagement of workers to whom monetary compensation is not paid.

1(4)

For the purposes of Parts 9 and 41 of the OHS Code, “a thing used or worn by a person” in the definition of “personal protective equipment” in section 1(ii) of the Act means any thing that is used or worn exclusively by a single worker at a given time to restrict, restrain, suspend, arrest or otherwise protect the worker from a fall.
